Understanding the Role of a Federal Defender
A federal defender is an attorney who represents individuals charged with federal crimes, either through appointment by the court or as a privately retained lawyer who practices primarily in federal court. Their central purpose is to ensure that defendants receive the full protection of the Constitution, including the right to counsel, due process, and a fair trial.
Federal defenders work exclusively within the federal justice system, which is separate from state courts. This means they handle cases involving violations of federal law, such as drug trafficking across state lines, white-collar crimes, weapons offenses, and other crimes investigated by federal agencies, including the FBI, DEA, IRS, and ATF.
How Federal Defenders Differ from State Public Defenders
While state public defenders represent defendants in local and state courts, federal defenders operate within the U.S. District Courts and U.S. Courts of Appeals. The laws, procedures, and sentencing guidelines in federal court are often far more stringent and technical than those in state court.
For example:
Federal Sentencing Guidelines are used to determine potential penalties and are notoriously severe.
Federal Investigations often last months or years before charges are filed, involving multiple agencies and grand jury subpoenas.
Discovery and Evidence Rules differ significantly from state court procedures, requiring deep familiarity with federal case law and evidentiary standards.
A qualified federal defender understands these distinctions and uses them to the client’s advantage. Their experience can make a decisive difference in the outcome of a case.
Key Responsibilities of a Federal Defender
The work of a federal defender begins long before trial and continues through every stage of the legal process. Some of their most important duties include:
Investigating the Case
A federal defender thoroughly examines the facts, interviews witnesses, reviews evidence, and identifies weaknesses in the prosecution’s case. This may include hiring investigators or forensic experts to challenge government findings.
Analyzing Federal Charges and Evidence
Federal laws often involve highly technical elements that the government must prove beyond a reasonable doubt. A skilled defender scrutinizes every detail of the indictment and the government’s evidence to find inconsistencies or violations of constitutional rights.
Negotiating with Federal Prosecutors
Before trial, federal defenders often engage in plea negotiations with the U.S. Attorney’s Office. They advocate for reduced charges, lower sentencing ranges, or even pretrial diversion programs when appropriate. Their understanding of federal sentencing guidelines is critical in these discussions.
Filing Motions to Protect Constitutional Rights
A federal defender frequently files pretrial motions—for example, to suppress illegally obtained evidence, dismiss defective indictments, or challenge improper search warrants. These motions can drastically alter the course of a case.
Representing Clients in Trial and Sentencing
When cases proceed to trial, the defender presents evidence, cross-examines witnesses, and makes legal arguments to a federal jury or judge. If convicted, they continue to advocate for a fair and proportionate sentence, often citing mitigating factors or arguing for departures under the Federal Sentencing Guidelines.
Handling Appeals and Post-Conviction Relief
If a defendant is found guilty, the federal defender can pursue an appeal in the U.S. Court of Appeals, arguing that errors during the trial or sentencing process violated the defendant’s rights. In some cases, they also assist with post-conviction motions, such as habeas corpus petitions or sentence reductions.

I was referred over to Attorney Ruzanna Poghosyan through a family member to consult with her for a pending case I had. Her office staff was very polite & understood that my circumstances were pretty urgent & gave me an appointment right away. After I met with her, I was amazed with how much knowledge she had & how gracious she was with not judging me. She was very respectful & right then I knew that she was the Attorney for me. This office without a doubt is highly recommended.

Ruzanna is quick to see the situation from every angle and offer prudent advice that will save your butt! She has saved me from several ‘sticky situations’ ensuring that my charges were reduced and even dropped wherever possible. She is quick to respond to all correspondence and willing to take the time necessary to ensure you understand the legal possibilities of your situation.
And on top of that she asks for a fair price for her services!! She actually helped me realize I was being swindled by another shark-like attorney who was using scare tactics to charge me ridiculous fees. Ruzanna was point-blank exposing the nature of the situation to me and offering several solutions that saved me time and money. And she will do the same for you as soon as you give her a call!

I first met Ms. Poghosyan a few years ago through a couple of mutual friends that had been represented by her in the past. I own a fairly large Body Shop in LA County that employs over 20 individuals as well as conducting business with hundreds of third party businesses. I have retained Ms. Poghosyan several times within the past years for a variety of legal issues. She has always fought my fights whether I was being investigated by the Bureau of Automotive Repair, or was called in to provide recorded statements… Ms. Poghosyan isn’t the type to ever leave your side & she makes that very clear by her actions.
Both her & her staff have never fallen short of my expectations. What I truly appreciate & admire is the fact that I know they are always a phone call away if I ever do need assistance. I’m not just a phone call that gets placed on hold, & for that as well as so many other things. Ms. Poghosyan will forever have my business. She is extremely educated in her field & from what I’ve seen; obtains a very credible & respected reputation in Court. Thanks for always being there for me!

I was referred to Ruzanna Poghosyan by a family friend for my case. Before contacting Ruzanna I was very nervous about my situation. Everybody was telling me I will go to jail. I couldn’t wait until Monday, so I called her on Saturday and she gave me an appointment on the same day. She was very helpful in answering my questions. I left her office knowing my case was in good hands. I ended up not going to jail and instead getting informal probation. I would definitely recommend Ruzanna to anyone looking for a criminal defense attorney because she is very knowledgeable in her field of practice.

I had received a DUI in Van Nuys, a known difficult court that does not grant any plea bargains. However, thanks to Ruzanna and her hard working efforts she was able to reduce my DUI into a reckless driving. I strongly recommend hiring Ruzanna as she is well prepared, communicates well explaining all premises clearly and puts the client’s mind at ease. She definitely knows what she is doing and is well experienced in criminal defense!

When my family 1st hired Mrs Poghosyan I was a immigration detainee. I was already in deportation grounds and only way to get out of that was to return to criminal court and get chance to change my plea to a lesser charge. Ruzanna did not give up until we won criminal motion to vacate plea. ONCE the motion was granted immigration court released me. We returned to criminal court me still out of custody and got my lesser charge. I thank Ruzanna for everything she did a great job and even more thankful for not giving up on my case because I know it was a very complicated case to figure out. In conclusion I recommend her to the fullest.

A few months ago I was pulled over by a police officer and was charged with a possession for sale. This was not my first offense and I was skeptical to reach out to another attorney since my first offense did not end well. A friend of mine referred me to Mrs. Poghosyan, stating that he had hired her previously for a similar offense. I called Mrs. Poghosyan and to my surprise she answered the phone, calmed me down and gave me an emergency appointment for the next day. Throughout the process to drop my charges, Mrs. Poghosyan was always quick to respond to any form of communication and she never missed my calls. Most importantly, however, Mrs. Poghosyan handled my case by herself; unlike my previous attorney who handed my case to his associate.
Because of Mrs. Poghosyan’s hard work, the charges against me were dropped and I did not go to jail. I will definitely recommend her to anyone who is looking for a hardworking and dedicated attorney.
